Agreement to terms
By accessing signalgist.com or using any Signalgist service, you agree to these Terms of Service. If you do not agree, do not use our website or services. “You” refers to you and, if applicable, the business you represent. “We,” “us,” and “Signalgist” refer to Signalgist, operated from Mount Pleasant, South Carolina.
Services overview
Signalgist provides website technical readiness services for local businesses. Our services include:
- Free website readiness check: A review of publicly available information on your website, delivered at no cost and with no obligation.
- Website readiness setup ($349, one-time): A technical audit and implementation of agreed website improvements related to search and AI discovery readiness.
- Ongoing monitoring ($29/month): Automated checks of technical readiness factors with alerts when issues are detected.
Services are subject to platform compatibility and scope confirmation before payment.
No guarantees of results
Signalgist improves the technical foundations of your website. We do not and cannot guarantee any specific outcome, including but not limited to:
- Improved search engine rankings or visibility
- Inclusion in AI-generated recommendations or answers
- Increased website traffic, leads, or revenue
- Specific placement in any search engine, AI tool, or directory
Search rankings and AI recommendations depend on many factors outside our control, including your content, reputation, competition, location, and the proprietary systems of third-party platforms. Our service addresses technical readiness, which is one factor among many.
Free website check
The free website check is a review of publicly available information. It does not require any login credentials or website access. Submitting the form constitutes a request for review, not an instant automated scan. We may contact you by email to deliver results and discuss our services. The free check does not create any obligation to purchase.
Paid services and payment
For the $349 website readiness setup:
- We confirm scope, platform compatibility, and access requirements before you pay.
- Payment is due before implementation begins.
- The scope of work is limited to the technical improvements described in your pre-purchase confirmation. Website redesigns, content creation, search engine optimization campaigns, and complex development work are not included and will be quoted separately if requested.
For the $29/month monitoring service:
- Monitoring begins after activation and continues on a monthly billing cycle.
- You may cancel monitoring at any time. Cancellation takes effect at the end of your current billing period.
- Monitoring covers automated checks and alerts. Additional repairs or implementation work is scoped and quoted separately.
Website access
If you hire us for the paid service, you agree to provide the minimum access necessary for us to perform the agreed work. We ask you to create a temporary administrator account for our use rather than sharing your personal credentials.
We agree to:
- Use your website access only for the agreed scope of work
- Create a restore point before making changes
- Remove or downgrade our access promptly after completing the work
- Not access, modify, or copy content beyond what is necessary for the agreed service
You are responsible for ensuring you have authority to grant us access to the website and to authorize the agreed changes.
Backups and liability for website changes
We create a backup of your website before making any changes. If our changes cause a problem, we will use that backup to restore your site to its prior state at no additional charge. Our liability for website changes is limited to restoring your website to its pre-service condition using the backup we created.
We are not responsible for issues caused by your own subsequent changes, third-party plugins or themes, hosting provider failures, or events outside our control.
Intellectual property
You retain ownership of all your existing website content, branding, and business information. We retain ownership of our tools, processes, scanning systems, and report templates. The specific report and data we generate for your business is yours to keep and use.
If we install any Signalgist-developed code on your website (such as a plugin or script), we grant you a non-exclusive license to use it on that website for the duration of your service agreement. We may remove or update Signalgist-managed components as part of our service.
Acceptable use
You agree not to:
- Provide false or misleading business information for us to include in your website’s structured data
- Use our services to misrepresent your business, services, location, or qualifications
- Attempt to reverse-engineer, copy, or redistribute our scanning tools or proprietary systems
- Use our website or services for any unlawful purpose
Limitation of liability
To the maximum extent permitted by law, Signalgist’s total liability for any claim arising from or related to our services shall not exceed the amount you paid us in the 12 months preceding the claim. We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, regardless of the theory of liability.
Disclaimer of warranties
Our services are provided “as is” and “as available.” We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will be uninterrupted, error-free, or that any specific results will be achieved.
Indemnification
You agree to indemnify and hold harmless Signalgist, its owners, and its contractors from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of our services, your violation of these terms, or your provision of inaccurate business information.
Refund policy
If we determine before beginning work that your website is not compatible with our service, we will not charge you. If we have already collected payment and cannot perform the agreed work, we will refund your payment in full.
Once implementation is complete and your report has been delivered, the $349 service fee is not refundable. Monthly monitoring fees are not refundable for the current billing period after cancellation.
Modifications to services or terms
We may update these terms from time to time. When we make material changes, we will update the effective date at the top of this page. Your continued use of our services after changes are posted constitutes acceptance of the updated terms.
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. For active monitoring subscribers, we will provide at least 30 days’ notice before discontinuing the monitoring service.
Governing law and disputes
These terms are governed by the laws of the State of South Carolina, without regard to conflict of law principles. Any disputes arising from these terms or our services shall be resolved in the state or federal courts located in Charleston County, South Carolina. You consent to the personal jurisdiction of those courts.
Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire agreement
These terms, together with our Privacy Policy, constitute the entire agreement between you and Signalgist regarding your use of our website and services. Any pre-purchase scope confirmation we provide supplements these terms for the specific engagement described.
